Terms
The licence you get when you buy Nifty, and the few rules that come with it, in plain English.
Who we are
Nifty is made by Viaduct Industries Limited (“we” or “us”), registered in England & Wales, company no. 15728702. Our registered office is 3rd Floor, 86–90 Paul Street, London, EC2A 4NE. You can reach us at [email protected].
These terms are an agreement between us and you, the person using Nifty. You agree to them when you buy a licence or install and use Nifty. If you buy as a consumer, nothing in them takes away your legal rights.
Trying Nifty
Nifty is free for 14 days, with no card needed. After that it becomes read-only until you add a licence: you can still open, search and download everything you’ve put in it. Nothing is deleted.
Your licence
When you buy Nifty, we email you a licence key. It lets you, personally, use Nifty:
- on as many of your own computers and servers as you like, the desktop app and the server together;
- for yourself or for your work;
- for good, on every version released during your year of updates.
A licence is for one person. Don’t share your key or let anyone else use Nifty with it. A licence can’t be transferred, sold or given to someone else.
You’re buying a licence to use Nifty, not the software itself, which stays ours.
Updates and renewals
Your licence covers every version we release in the year from the day you buy. After that, Nifty keeps working on the last version your licence covers, with all your data. Renewing gets you another year of updates at the price on our website at the time. It’s up to you whether and when you renew.
What you mustn’t do
- Share, publish or sell licence keys.
- Get around the licence check, the trial or read-only mode.
- Copy, sell, rent or distribute Nifty, or change it, except as these terms or the law allow.
- Reverse engineer or decompile Nifty, except where the law allows it.
Nifty includes open-source software under its own licences. Those licences apply to those parts, and nothing here limits your rights under them.
Your data
Your data is yours. It stays on your own computer or server, and we don’t receive it, with two exceptions in Nifty Plus. We keep emails you forward to Nifty, and items other apps send to it, encrypted until your Nifty collects them. With Remote, traffic between your devices and your Nifty passes through our service encrypted, so we can’t read it. What we do collect, when you buy, join the mailing list, send an error report, forward an email, send an item or use Remote, is in our privacy policy. If you connect Nifty to an AI model or another service, what Nifty sends it is covered by that provider’s terms.
Nifty keeps everything in one folder, so please back it up regularly.
Refunds and cancelling
If Nifty isn’t right for you, email us within 14 days of buying and we’ll refund you in full, no questions asked, even after you’ve added your key. If you’re a consumer, this is also your legal right to cancel. We refund within 14 days of hearing from you, to the way you paid.
To cancel, email [email protected] saying so, or send us this form:
To Viaduct Industries Limited, 3rd Floor, 86–90 Paul Street, London, EC2A 4NE, [email protected]:
I cancel my contract for a Nifty licence, bought on [date].
Name: [your name]. Email address I bought with: [email]. Date: [today’s date].
A refund cancels your licence key. Your data stays where it is, and you can still open, search and download it.
After 14 days you still have your legal rights if Nifty is faulty or not as described.
Betas
Beta versions are free previews. They may have bugs and may change before a full release, and they always send error reports (see the privacy policy). As far as the law allows, we provide them as they are.
Remote
With Nifty Plus, Remote lets your own devices reach your Nifty through our service.
- Beta: Remote is in beta. How it works, including how apps connect to it, may change, and it may sometimes be unavailable.
- When it works: only while your Nifty is running and the computer it runs on is awake.
- Fair use: Remote carries up to 20 GB a month. Above that, your devices can’t connect until the next month starts. We may limit or suspend Remote if it’s used to harm our service or other people.
- Your devices: you’re responsible for the devices you pair and for keeping them secure. Revoke any you lose or no longer use. A paired device can do anything the Nifty API allows.
- Apps: apps from others that work with Remote are covered by their own terms.
- When it stops: Remote stops if your Nifty Plus subscription ends.
Our responsibility to you
We build Nifty with reasonable care and skill. If you’re a consumer, the law says digital content must be as described, fit for purpose and of satisfactory quality.
We’re not responsible for losses we couldn’t have foreseen. If you use Nifty for work, we’re not responsible for lost profit, revenue, business or opportunity, and our total responsibility for that use is limited to what you paid for your licence.
Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t let us limit.
Ending your licence
You can stop using Nifty whenever you like. We can end your licence if you seriously break these terms, for example by sharing your key, or if your payment is reversed. Your key then stops working, but your data stays where it is and you can still open, search and download it.
Changes to these terms
We may update these terms, and we’ll change the date at the top when we do. The terms in place when you buy apply to that purchase; a renewal uses the terms in place at the time.
The law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can bring a claim in your own courts. If you live in the European Union, you keep the protection of your own country’s consumer law and can bring a claim in its courts.
